PERLINDUNGAN HUKUM BAGI PEMILIK SERTIFIKAT TANAH ELEKTRONIK PASCA DISAHKANNYA PERATURAN MENTERI ATR/BPN NOMOR 3 TAHUN 2023 TENTANG SERTIFIKAT TANAH ELEKTRONIK

This research is motivated by legal protection efforts for holders of electronic land certificates from data hacking that causes duplication and forgery of electronic certificates regulated in the regulation of the Minister of Agrarian Affairs and Spatial Planning number 3 of 2023 concerning electronic land certificates. The purpose of this study is to determine and analyze the arrangements regarding legal protection for holders of electronic land certificates both preventively and repressively. The research method used is normative legal research to examine and analyze legal norms in applicable laws and regulations related to legal protection for holders of electronic land certificates after the enactment of the Regulation of the Minister of ATR / BPN Number 3 of 2023 concerning Electronic Land Certificates, through legal, conceptual and case-related approaches. Based on the results of the study, there are preventive arrangements in the event of hacking that results in duplication of certificates, one of which is stated in article 20 paragraph (4), Regulation of the Minister of ATR / BPN Number 3 of 2023, that the security of authenticity is equipped with a Quik Response Code (QR Code) Then the second repressive protection can be taken through litigation if this happens, namely the State Administrative Court (PTUN) which refers to Article 85 paragraph (4) of Law No.9 of 2004 amending Law No. 5 of 1986 concerning State Administrative Courts and the State Administrative Court.
