Abstract

This study aims to examine the protection of personal data for debtors in the Shopee Spinjam online loan application. This research discusses how the process of non-performing loan settlement involves the use of personal data in Shopee Spinjam online loans and how personal data is used when loans become non-performing, reviewed from the perspective of personal data protection. The research method used in this study is empirical juridical research, which is a type of research employed in writing this thesis using a sociological juridical approach. This approach is used in legal research to observe legal phenomena in the field and how the law is applied in society. The data collected comes from interviews, applicable laws and regulations, books, journals, mass media, the internet, and other references related to the process of non-performing loan settlement in online loan applications. The results of this study indicate that the process of settling non-performing loans through the use of personal data in Shopee Spinjam online loans still violates existing legal provisions and is not optimal in the management of personal data, as evidenced by data leaks to third parties. The Financial Services Authority (OJK) should establish appropriate regulations to control and monitor the data collection techniques used and ensure proper handling of personal data. This is crucial to perfecting the regulations outlined by the OJK for third parties, and continuous attention should be given to safeguarding personal information.
