REFORMULASI PERBUATAN KAWIN KONTRAK SEBAGAI TINDAK PIDANA PERDAGANGAN ORANG DI INDONESIA

Contract marriage is a new type of human trafficking that often occurs in Cisarua, Bogor Regency and Kalisat Village, Pasuruan Regency. In terms of implementation, the contract marriage is with a certain period of time according to the agreement of both parties and the existence of brokers or pimps who become third parties to connect between the two. This practice still continues because there is no law that specifically regulates these actions. So, this research aims to analyse the correlation between contract marriage and the crime of human trafficking and formulate the act of contract marriage as a crime of human trafficking. The research method used is normative juridical using a statutory approach and concept approach and collecting data by means of literature study. From the results of this study, the authors obtained answers to the problems in this study that there is a legal vacuum that occurs regarding the formulation of the act of contract marriage as a criminal act of human trafficking in Indonesia which is based on philosophical, sociological and juridical foundations that encourage the reformulation of the act of contract marriage as a criminal act of human trafficking.
