IMPLEMENTASI STOCKHOLM CONVENTION DAN MINAMATA CONVENTION DALAM KASUS POLUSI LINTAS BATAS UDARA OLEH TIONGKOK DI KAWASAN ASIA TIMUR

This study examines the implementation of international law in addressing transboundary air pollution caused by China in the East Asia region. Using Anthony Aust's theoretical framework on international law, the research analyzes the extent to which international legal principles are applied in mitigating environmental harm across borders. The study employs a qualitative descriptive method with a content analysis approach to explore primary and secondary data, including international treaties, state declarations, and reports from relevant organizations. Findings reveal that China hasn’t many ratified the transboundary related issue treaties, although they still managed to carry the problem into solving proggres, which is significant. While international legal frameworks, such as the convention and the principle of state responsibility, provide foundational guidance, enforcement remains a challenge due to the sovereignty nor wasn’t include in treaties. The study highlights the need for stronger regional cooperation and enhanced compliance mechanisms to address transboundary air pollution effectively.
