REKONSTRUKSI HUKUM INVESTASI KOMODITAS ASET KRIPTO (CRYPTO ASSET) TERKAIT PERLINDUNGAN HUKUM BAGI PARA INVESTORNYA

The development of digital technology has encouraged the creation of cryptocurrency as a new investment asset that has attracted global attention, including in Indonesia. This study focuses on the reconstruction of crypto asset commodity investment law in Indonesia with an emphasis on legal protection for investors. The purpose of this study is to analyze the regulation of legal protection for crypto asset investors, analyze the dispute resolution mechanism for crypto asset investments through the Commodity Futures Trading Arbitration Board, and formulate a more comprehensive and specific legal reconstruction of the legal protection of crypto asset investors. The research method used is normative juridical with a statutory and conceptual approach. The existing legal materials are then analyzed descriptively, interpretively, evaluatively, and systematically. The results of the study show that the current main regulation, namely Bappebti Regulation Number 8 of 2021, is still lacking in providing specific and comprehensive legal protection for crypto asset investors, including regarding dispute resolution. There is a need for a more comprehensive regulatory update to improve supervision and legal protection for crypto asset investors in Indonesia. In conclusion, a legal reconstruction is needed that includes explicit regulations regarding legal protection for crypto asset investors and their dispute resolution mechanisms. Advice to the government to accelerate regulatory updates related to crypto assets in order to optimally protect investors considering the very rapid and dynamic development of crypto assets themselves.
