Abstract

This research focuses on the legal implications of the incident involving a Batik Air pilot and co-pilot falling asleep during a flight from Kendari to Jakarta on January 25, 2024. The incident, which raised public concern, highlights the importance of aviation regulations, particularly those related to pilot rest and work hours. The study aims to analyze Indonesian aviation regulations concerning pilot work hours, rest periods, and responsibilities for ensuring flight safety. It also examines the legal accountability of the pilot and co-pilot based on national law. The research compares Indonesia’s regulations with international standards, particularly those applied in countries with the highest aviation safety ratings. By comparing these standards, the study explores potential gaps and weaknesses in the Indonesian regulatory framework. Furthermore, the study provides insights into how Indonesia’s aviation regulations could be improved to align with best practices in international aviation law. The research concludes by offering policy recommendations to the Indonesian government and aviation authorities to enhance the implementation of pilot rest regulations and ensure greater compliance with international safety standards, ultimately aiming to prevent similar incidents in the future.
