Abstract

This Final Project is prepared to provide the public with an overview of legal events regarding how the law should function properly to create justice and peace within society. In its implementation, the law still faces violations of established regulations, one of which is the criminal act of theft, which can be influenced by low economic factors. Theft is a crime that, in practice, is often committed in specific ways that aggravate the offense, as regulated in Article 363 of the Indonesian Penal Code (KUHP). This study aims to explain the process of resolving the criminal case of aggravated theft in case number 107/Pid.B/2024/PN Kpn. The writing method used in preparing this Final Project is the Empirical Juridical method, with primary data collected through court proceedings, copies of related case decisions (specifically decision number 107/Pid.B/2024/PN Kpn), and interviews with the attorney handling the case at the author's internship site. Additionally, secondary data includes the Indonesian Penal Code (KUHP), the Indonesian Criminal Procedure Code (KUHAP), and the tertiary legal materials such as journals, articles, and other relevant legal sources. According to the author, the process of resolving the criminal case of aggravated theft has been carried out in accordance with the Criminal Procedure Law, meaning there is no discrepancy between theory and practice. This writing is expected to serve as a reference for research and the development of knowledge, particularly in the fields of Criminal Procedure Law and Criminal Law, related to cases of aggravated theft.
