Abstract
Theft with aggravation is referred to as qualified theft, which is carried out
in certain ways and circumstances that are burdensome so that the criminal threat is heavier than ordinary theft. Decision number 199/Pid.B/2024/PN.Kpn stated that the Defendant with the initials SBT was legally and convincingly proven to have committed the crime of theft with aggravation, as the sole indictment of the public prosecutor using Article 363 paragraph (1) 4 of the Criminal Code, as for the elements of Who's Goods; Taking possession of something which belongs wholly or partly to another person, with the intention of unlawfully possessing it, committed by two or more persons in association; In the trial process, the agenda for the reading of the judge's decision handed down a criminal verdict to the Defendant with a prison sentence of 1 (one) year and 2 (two) months. This writing
aims to analyze and explain the process of resolving the case of theft with
aggravation in case registration number 199/Pid.B/2024/PN.Kpn. The writing
method in the preparation of this final project uses an empirical juridical method with primary data obtained from a copy of the decision of case
199/Pid.B/2024/PN.Kpn as well as interviews with the defendant and advocate. To complete the existing data, the author uses secondary data which includes the Criminal Code, the Criminal Procedure Code, and other legal materials.
