IMPLEMENTASI PERIZINAN PENJUALAN MINUMAN BERALKOHOL BERDASARKAN PERATURAN DAERAH KOTA BANJARMASIN NOMOR 10 TAHUN 2017 TENTANG PENGAWASAN DAN PENGENDALIAN PENJUALAN MINUMAN BERALKOHOL (STUDI DI KOTA BANJARMASIN)

The polemics that can be caused by the controversy over the licensing of alcoholic beverages in Banjarmasin City can have impacts such as sociological, economic and normative aspects. Banjarmasin City Regional Regulation No. 10/2017 is still considered less than optimal in its implementation. In terms of normative basis, supervision and administration, it illustrates a weakness in the implementation of the local regulation. This study aims to find out about the implementation and constraints on licensing listed in certain articles in Banjarmasin City Regional Regulation Number 10 of 2017 concerning Supervision and Control of Alcoholic Beverages. This research uses a juridical-sociological approach method with research instruments using interview methods with related parties and digging up secondary data related to problems in licensing. Based on this research, it has been found that there is overlapping in the implementation of legal hierarchies such as applying for alcoholic beverage licenses in the regions with applying for licenses directly to the Online Single Submission (OSS), thus bringing problems in the supervision of sales licenses. Another finding is the obstacles that arise from juridical factors such as difficulties in renewing licenses because the recommender is still based on the will of the community in the neighborhood. The conclusion shows that there is overlapping in the implementation of the regulatory hierarchy which has an impact on constraints in supervision as well as license renewal, external factors are also a polemic in the implementation of licensing in a social environment based on religious aspects. Suggestions, improvements to local regulations so that they can be more optimal and objective in issuing permits, better integration so that there is integral management from the central government and local governments to be effective in avoiding overlapping.
