Abstract

Crypto assets, specifically nonfungible tokens (NFTs), have emerged as a common trend in trading. This matter has a significant influence, resulting in great profits for business entities and also great losses for them. Regulations regarding NFTs are still sparse, thus providing an opportunity for overarching regulation. The problems discussed in this study are: How are the regulations for digital assets in the form of NFTs (nonfungible tokens) in Indonesia's positive law? What are the legal implications of regulating NFT (nonfungible token) digital assets? This study aims to ensure and review regulations for investing in digital assets in the form of NFTs (nonfungible tokens) in Indonesia's positive law; and to ascertain and research the legal implications of regulating NFT (nonfungible token) digital assets. The study used, namely normative juridical, is supported by a statute approach with a method of collecting legal materials for literature studies in the form of books, journals and scientific articles, laws and regulations, and other documents related to research, including the use of qualitative descriptive analysis. The findings make it clear that there are no regulations that regulate NFTs in detail, creating a legal vacuum that creates legal uncertainty. Seeing the implications of this legal uncertainty, concrete steps are needed to improve existing regulations to provide protection of the rights of legal subjects and consistency in fair and proportionate law enforcement. Therefore, it is necessary to revise and add regulations related to NFT regulation and the state is also obliged to ensure that if technology development is carried out responsibly, clear rules are needed so that it can be used as an innovative approach for the government to regulate technology.
