EFEKTIVITAS PELAKSANAAN AMDAL DALAM UNDANG-UNDANG NO. 6 TAHUN 2023 TENTANG PENETAPAN PERATURAN PEMERINTAH PENGGANTI UNDANG-UNDANG NO. 2 TAHUN 2022 TENTANG CIPTA KERJA MENJADI UNDANG-UNDANG (Studi di Wilayah Hukum Kota Malang)

This study analyzes the effectiveness of AMDAL implementation under Law No. 6 of 2023 in Malang City. The research questions include: How effective is the implementation of AMDAL according to Law No. 6 of 2023, what are the challenges, and how does the Environmental Agency of Malang City address these challenges? Using a socio-legal approach, the data sources include Law No. 6 of 2023, Government Regulation No. 22 of 2021, and interview results. Data collection techniques consist of interviews, observations, and document studies. Data analysis applies a qualitative descriptive method. The research findings reveal that AMDAL implementation has not been fully effective. The procedural simplification through the establishment of the Environmental Feasibility Test Team has improved administrative efficiency but reduced transparency and public participation. Key challenges include limited human resources, inadequate infrastructure, and low public legal awareness. Efforts undertaken involve staff capacity building, strengthening interagency coordination, and raising public awareness. This study recommends a holistic approach that integrates regulations, technology, and local cultural values to enhance the effectiveness of AMDAL implementation in the future.
