Abstract
The rise of trafficking in persons in Indonesia has been recorded to have reached 1,418 cases and 1,581 cases from 2020 to 2022 victims of trafficking in persons were reported. And in 2023, there were 252 adult victims and 206 child victims. Based on this data, women and children are the majority of victims of human trafficking. Victims of human trafficking crimes are the most disadvantaged parties. Because they experience continuous suffering and trauma as a result of these acts. Often, victims do not get the protection they deserve, so that the victim's condition is neglected and their rights are not fulfilled as a result of the actions of the perpetrator who has been sentenced to criminal sanctions by the court. Therefore, victims have rights as stipulated in Law Number 21 of 2007 concerning the Eradication of Trafficking in Persons, this right is the right to restitution. The purpose of restitution is to hold perpetrators accountable for the impact of the crimes they commit, in order to overcome all losses experienced by victims. Restitution functions in assisting victims in the process of healing wounds and mental disorders, as well as recovering from the loss of their wealth by considering the value of the fine given by the perpetrator. In the implementation of the right to restitution, it must be based on the principle of restitutio in integrum (restoration in all circumstances), that is, all efforts must be made to restore the condition of the victim.
