Abstract

The issue of the availability of Social Welfare Organizing Institutions (LPKS) has become a critical concern in protecting the rights of children in conflict with the law. This study focuses on a case of abuse involving underage children in Malang Raya, highlighting the urgent need for adequate social rehabilitation facilities. The research aims to analyze the urgency of LPKS availability and the challenges faced in its realization. The study employs a juridical-empirical method with a socio-legal approach. Data were collected through interviews with advocates, correctional institutions, and social organizations, as well as an analysis of relevant legal documents. The findings reveal that the absence of adequate LPKS facilities hampers the rehabilitation process for children in conflict with the law, despite existing laws emphasizing the importance of such facilities. Implementation faces numerous challenges, including limited government attention, budget constraints, and a lack of public understanding of LPKS roles. This study highlights the importance of synergy between the government, social institutions, and the community in providing adequate LPKS facilities to ensure children's rights are protected in line with restorative justice principles. The research suggests policy recommendations to enhance government focus on the development and sustainable operation of LPKS facilities.
