Abstract
Default occurs when someone is negligent in fulfilling obligations established by law. This case often becomes a problem faced by society, especially in the world of business and civil contracts. One of the relevant cases is the case at the Kepanjen District Court Number 93/Pdt.G/PN.Kpn. This research aims to determine and analyze the implementation of default dispute resolution in case registration number 93/Pdt.G/2024/PN.Kpn. The research uses empirical juridical methods, namely a sociological legal approach carried out through field studies to observe the application of law in people's lives. In this case, a form of breach of contract occurred because the defendant had done what he promised but was late in carrying out his achievements. The defendant was negligent in fulfilling hisj obligations as stated in the house sale and purchase agreement. Dispute resolution is carried out through litigation at the Kepanjen District Court in accordance with its absolute and relative authority. In his decision, the judge used the principle of pacta sunt servanda and Article 1234 of the Civil Code to assess the defendant's negligence based on the agreement that had been made. To prevent similar problems, it is recommended that the parties involved be more careful in drafting agreements, especially those of large value. Apart from that, people should make agreements before an authorized official such as a notary to ensure the agreement is legally valid and reduce the potential for conflict in the future.
