LEGAL STANDING DALAM KEWENANGAN ORANG TUA SEBAGAI PEMOHON PEMBATALAN PERKAWINAN TERHADAP ANAK YANG BERBEDA AGAMA (STUDI KASUS PADA PERKARA NOMOR: 462/PDT.G/2024/PA.MLG)

The application for annulment of marriage can be made by several parties including the parents of the bride and groom. However, the application cannot be made without clear legal standing and the requirements must be known in advance. This study aims to determine the legal standing of parents in submitting an application for annulment of marriage to their children who are of different religions. The type of research used by the author is normative juridical using descriptive qualitative data analysis methods. The data collection techniques used by the author come from interviews, documentation, and literature searches. The results of this study are the existence of the right to sue or legal standing that underlies the application for annulment of marriage and the considerations of the Panel of Judges which have been analyzed based on the Civil Code (KUHPerdata), Law Number 1 of 1974 About Marriage, and the Compilation of Islamic Law (KHI). Through this study, the author argues that the public should know the requirements and pillars of marriage according to the provisions of the legislation so that in life after marriage there are no more problems related to the requirements of marriage. Meanwhile, for law enforcement officers, they should be able to resolve marriage problems based on the laws that were raised as the study of this research.
