Pengukuran Etika dan Profesionalisme Advokat dalam Penegakan Hukum: Perspektif Hubungan dengan Rekan Sejawat (Studi Perkara Nomor 2009/Pdt.G/2024/PA.Kab.Mlg)

ABSTRACT

Advocates are one of the spearheads in law enforcement, playing a role in defending and assisting the legal process both inside and outside the courts. This profession is regulated by Law Number 18 of 2003 concerning Advocates and the Indonesian Advocates Code of Ethics (KEAI), which provides moral and professional guidelines in carrying out duties. This study aims to analyze the application of ethical values and professionalism of advocates, with a case study in case Number 2009/Pdt.G/2024/PA.Kab.Mlg involving colleagues from the same organization, namely PERADI "SAI". The study uses an empirical legal approach that combines normative and empirical analysis through direct observation, interviews, and document analysis. The relationship between advocate colleagues, as regulated by KEAI, faces challenges in practice, especially in maintaining professionalism and ethics when litigating as opponents. This case reveals the importance of advocates to prioritize integrity, fairness, and respect for colleagues, without sacrificing the interests of clients. Examples of ethical violations in various places increasingly emphasize the need to enforce professional values to maintain the dignity of the profession and public trust in the legal system. This study emphasizes that harmonious relationships between advocates, mastery of legal theory and practice, and an objective attitude are fundamental elements for the sustainability of the advocacy profession. This approach aims to strengthen professionalism and ethics, so that advocates can carry out their roles as competent and dignified law enforcers. This study is expected to contribute to developing discourse on professional ethics and legal practice in Indonesia.
