TINJAUAN YURIDIS EMPIRIS PENANGGULANGAN PENCEMARAN LIMBAH B3 YANG DISEBABKAN OLEH PT. PUTRA RESTU IBU ABADI DI MOJOKERTO

Law Number 32 of 2009 concerning Environmental Protection and Management is a specialist law that regulates environmental protection. However, the problem in this research is that in the Mojokerto area there are PTs that operate in the waste processing sector but they violate the rules in UUPLH. The PT is called PT. Son of Eternal Mother's Blessing. Violations committed by PT. Putra Restu Ibu Abadi is stockpiling B3 waste in his factory environment. Meanwhile, B3 waste is hazardous waste and causes soil pollution around the factory environment. The aim of this research is to find out and understand how to deal with B3 waste pollution and prevent environmental pollution, to find out the obstacles in implementing pollution control caused by PT Putra Restu Ibu Abadi so that they can be resolved. The research methodology used is sociological juridical. The theory used in this research is environmental law theory, namely state responsibility theory, polluter pays theory, participatory theory. Controlling Pollution Due to B3 Waste PT. Putra Restu Ibu Abadi in Mojokerto was carried out in 2 ways, namely by litigation and non-litigation. PT HR does not have awareness of environmental sustainability and inconsistent control by relevant officials. The author's suggestion for this research is to tighten supervision, add facilities and infrastructure, maximize existing human resources.
