PENYELESAIAN SENGKETA KEPEMILIKAN HAK ATAS TANAH DENGAN STATUS HAK MILIK PADA PERKARA NOMOR 79/PDT.G/2023/PN.BIL

The dispute occurred over the Certificate of Ownership for a plot of land with an area of 181m² located in Legok village, Gempol District, Pasuruan Regency. The plaintiff stated that the defendant had violated Article 1365 of the Civil Code concerning unlawful acts by illegally controlling the object of dispute belonging to the plaintiff and causing harm to the plaintiff. The aim of this research is to analyze the implementation process for resolving land ownership disputes with property rights status in case number 79/Pdt.G/2023/PN.Bil. The type of research that will be used by the author is empirical juridical research which is a type of legal research with field research, which examines applicable legal provisions and what has happened in people's lives. Based on the results of the discussion, the Defendant could not prove that the object of the dispute belonged to the Defendant due to the lack of relevant documentary evidence and much of the evidence was ruled out by the panel of judges, so in the decision the panel of judges determined that the Plaintiff was the legal owner and the Defendant was declared to have committed an Unlawful Act. The author's advice regarding the evidentiary process is that all parties should ensure the authenticity of the documents submitted to minimize legal doubts. The National Land Agency needs to increase supervision over the issuance of certificates so as not to trigger similar disputes in the future.
