PENYELESAIAN SENGKETA PEMBAGIAN HAK WARIS TERHADAP PARA AHLI WARIS PADA GUGATAN NOMOR REGISTRASI PERKARA 372/PDT.G/2024/PA.BGL

The complexity of inheritance law in Indonesia involves customary law, Islamic law, and law from Burgerlijk Wetboek (BW). The aim of this research is to analyze the dispute resolution process that occurred in this case and provide recommendations for future improvements. In writing the research used is an empirical juridical research type by collecting data from trial results and interviews showing that there are several legal principles underlying the distribution of inheritance rights, such as bilateral principles and individual principles, which influence court decisions. The completion of this research provides an in-depth analysis of the legal process that heirs go through and the challenges they face in obtaining inheritance rights, as well as to increase public understanding of inheritance law and the importance of resolving disputes fairly and transparently. It is hoped that this research can become a useful literature source for academics and legal practitioners in understanding the dynamics of resolving inheritance disputes in Indonesia.
