Abstract

Registration of marriage through the issuance of a marriage deed is an important thing in a marriage because it is evidence that has the value of authenticity and legal truth and is a legal requirement for a marriage as explained in Law Number 1 of 1974 concerning marriage. The talak divorce case number 2266/Pdt.G/2024/PA.Kab.Mlg it is known that there were two marriage deed in the marriage of the Petitioner and Respondent, namely marriage deed number 244/23/IX/03 and marriage deed number 3507091102023110, so from this background the author conducted this research. The aim of this research is to determine the validity of a genuine but fake marriage deed and to determine legal certainty if there are two marriage deed in one marriage. The research method used in this research is Empirical Juridical. The results of the research carried out revealed that the marriage deed number 244/23/IX/03 was invalid according to applicable law because it did not comply with the legal requirements of the law and expert opinion. Two marriage deed in one marriage are also not permitted according to the law according to the theory of legal certainty. Marriage deed number 244/23/IX/03 does not meet the legal requirements of the decree, namely final and in accordance with the law. Two marriage deed in one marriage need to take steps to validate one of the marriage deed for the sake of legal certainty to protect the rights of the parties. If a marriage deed is genuine but fake, the public should avoid making a new marriage deed and officials at the Office of Religious Affairs need to carefully pay attention to the steps to validate the original but fake marriage certificate for the sake of legal certainty.
