Abstract
Technological and scientific advancements have significantly impacted various fields, including forensic medicine. Autopsies play a crucial role in uncovering homicides by providing accurate information on the cause of death. However, the implementation of autopsies in Indonesia often faces challenges due to unclear legal
regulations, particularly in the Criminal Procedure Code (KUHAP). This research aims to address two key questions: whether autopsies are mandatory in homicide investigations and what procedures are outlined in KUHAP. Using a normative juridical research method, this study analyzes primary data from legislation and secondary data from related literature. The findings reveal that Article 134 of KUHAP contains vague norms, leading to inconsistent interpretations and practices in homicide cases. Based on these findings, it is recommended to revise KUHAP to clarify the obligations and procedures for autopsies and to enhance law enforcement's understanding of their importance in achieving material truth.
