ANALISIS YURIDIS EMPIRIS PRAKTEK PERJANJIAN JUAL BELI HASIL UNGGAS (STUDI KASUS DI UD FARIDA TELUR MATARAM)

This study aims to evaluate the implementation of the cooperation agreement in the sale and purchase of poultry products between UD Farida Telur and its partner, UD Asfa Jaya Farm, and to identify the forms of default that occur and their resolution mechanisms. Using an empirical legal approach, and data collected through interviews with business actors. The results of the study indicate that this cooperation agreement generally meets the legal requirements according to Article 1320 of the Civil Code, including agreement, legal capacity, clear objects, and lawful causes. However, there are a number of defaults that arise, such as late delivery and non-conformity of product quality, which have the potential to cause disputes. This study also found that the dispute resolution mechanism used is through deliberation or negotiation. The recommendation from this study is the importance of preparing a more detailed agreement, including provisions regarding rights and obligations, as well as clear dispute resolution steps, to increase legal certainty and prevent default. This finding is expected to contribute to the development of cooperation agreement practices in the poultry sector.
