Abstract

The study, entitled "Settlement of Debts and Claims Carried Out By Non-Heirs Due To The Death of The Debtor" (Study Case Number: 673/Pdt.G/2024/PN. SBY)" aims to find out how the process of settling debt and claims that are in default can be carried out in case no. 673/Pdt.G/2024/PN. SBY when it occurs because the debt is passed to someone who is not the heir of the deceased debtor, and the author's purpose in this investigation is to find out what the debtor's responsibility is when the debtor dies.
In accordance with the stated objectives, the author chooses the formulation of the first problem, such as what is the debtor's responsibility if the debtor dies, and secondly, what is the process of resolving debt and claim cases in case no. 673/Pdt.G/2024/PN. Sby?
The type of research used is the type of empirical research, or in short, the research in which data is obtained from the field using the method of the social law approach. The location of this research was carried out in the law firm Sugiarto.Law & Partner and in the Surabaya District Court.
The results of this study are to provide an explanation for a person who has the right to pay the debts of a deceased person who is the heir of the deceased debtor, and to explain the debtor's limits and responsibilities. In addition, the author also addressed the settlement process in case number 673/Pdt.G/2024/PN. SBY, which was in accordance with the procedures and procedural regulations in accordance with the applicable legislation.
