In divorce cases in religious courts, the plaintiff and defendant do not always attend the trial process in accordance with the regulations that have been determined so that if one party does not attend the trial without a valid reason and does not heed the summons from the court bailiff, the panel of judges with all their considerations will decide the case by means of a verstek decision as regulated in article 124 HIR and article 125 HIR. This research aims to find out what legal consequences arise for the defendant for not attending the trial process as a result of making an agreement outside the court. The research method used in this research is empirical juridical, namely research that goes directly into the field with a type of qualitative research at the law office of SMU Law Office which is located at Jalan Mustari Kav 2 RT 8 RW 12, Ngaglik sub-district, Batu sub-district, Batu tourist city which is also place for a writer's internship in the Coe Batch 3 program organized by the law faculty of Muhammadiyah University, Malang. Based on data in the field, it shows that the defendant's absence from the trial process was motivated by an agreement outside the court between the plaintiff and the defendant so that the case would be decided in a formal manner and the trial would run smoothly because there was no resistance so that the action of avoiding the actual legal process gave rise to several legal consequences that had to be accepted. by the defendant. In this way, so that actions like this do not happen again, it is hoped that people will be more aware of complying with existing regulations as good citizens.
