Abstract

Indonesian society is familiar with the family method of dispute resolution, which is accommodated in civil procedural law. Nevertheless, mediation in civil procedural law is still unsuccessful in achieving peace. The purpose of this study is to determine the effectiveness of the implementation of mediation in court to resolve civil disputes, as well as the factors that influence this effectiveness. In this research, the author uses empirical juridical research or sociological research, so that the author conducts research by going directly to the field or research location. The results of the research obtained by the author on the case study of Case Number: 83/Pdt.G/2024/PN MLG, it can be concluded that the implementation of mediation in court can be carried out effectively as in PERMA 1/2016. The effectiveness of the implementation of mediation is supported by legal factors, law enforcement, infrastructure, culture, and the time of mediation implementation. The community is actually an inhibiting factor in the effectiveness of the implementation of mediation due to high ego. However, these inhibiting factors can be suppressed and covered with other supporting factors, so that the implementation of mediation can still be said to be effective. These factors must be implemented in tandem, and there is a match between the provisions in PERMA 1/2016 and its practice, so that it will result in effective mediation. Regarding factors inhibiting effectiveness, it is hoped that the community will be wiser in raising and lowering egos, and be able to respect each other's rights, so that mediation can be carried out much more effectively.
