Abstract

This study aims to determine the legal protection for users of online lending
services based on fintech and to find out whether the regulations for fintech-based
lending services provide legal protection. The type of research used is normative
law, legal research conducted by examining library materials . The legal material
collection technique used is library research . by searching for and collecting
relevant legal materials. The results of the study show that existing regulations
still have weaknesses in dealing with legal and illegal fintech providers who
violate collection ethics and misuse users' personal data. The main challenges
include intimidation by debt collectors, low transparency of information, and lack
of consumer education. The latest regulations such as SEOJK 19/SEOJK.06/2023
have regulated in more detail the use of third parties for collection, but have not
been fully integrated into parent regulations, such as POJK 10/2022, so that legal
protection for users is still not optimal. Fintech complaint mechanisms are also
often ineffective, making it difficult for consumers to obtain fair solutions. The
study recommends strengthening supervision by OJK through cooperation with
law enforcement officers, increasing sanctions for violators of regulations, and
socialization to improve financial literacy. Personal data protection, debt
collector training, and transparency in the lending process must be tightened. The
implementation of the responsible lending principle is also important to protect
users from exploitation and build public trust in fintech services. With this step,
the fintech ecosystem is expected to develop healthily, safely, and sustainably,
while providing optimal legal protection to users
