Abstract
Grant in Kitab Undang Undang Hukum Perdata (KUHP) Burgerlijk Wetboek Article 1666 namely: "A grant is an agreement by which the grantor, in his lifetime, freely and irrevocably surrenders an object for the purposes of the grantee who receives the surrender. The law does not recognize other grants among living people. Methods used Empirical law research, also known as sociological legal research, is a legal research that examines law that is conceptualized as actual behavior (Case Approach) by involving and reviewing every case related to a court decision that has permanent legal force. Mediation is one of the non-litigation
efforts required in every civil case in a court that seeks peace. This study aims to analyze the process of implementing mediation in case Number 4110/Pdt.G/2024/PA Regency Mlg involving a dispute between the Heirs (Plaintiff) and the Grant Recipient of the step-grandson (Defendant). The case in this study is that the Defendant received a grant from the Grant Provider in excess of 1/3 and
in the process of granting the grant was not accompanied by the legal heirs who at that time the grantee was in an unhealthy and dilapidated condition. The research uses an empirical juridical approach through the study of case documents, interviews with mediators, and analysis of related regulations.The results of the
study show that the mediation process in this case did not reach an agreement or can be said to have failed due to differences in principle between the parties in case Number 4110/Pdt.G/2024/PA Kab Mlg and this case continues to the next.
