Abstract

With case study No. 198/Pid.Sus/2024/Pn Mlg, this study discusses the legal force of witness evidence of testimonium de auditu in traffic accident criminal cases. One type of evidence that can be accepted in court is testimonium de auditu, or witness testimony after hearing someone else's story or statement about a criminal event. The purpose of this study is to evaluate the extent to which testimonium de auditu can meet the standards of valid and convincing evidence in court, and how the court assesses and verifies the credibility of the evidence in their decisions.
This researcher uses a type of empirical legal research or empirical juridical, which views law as a social phenomenon. The approach method used is the case approach.
The results of the study show that testimonium de auditu cannot be used exclusively as primary evidence, but can strengthen other relevant evidence as long as it is based on the principles of criminal law evidence, such as the accuracy and reliability provided by the witness.
