Abstract
The rapid development and advancement of information technology has caused changes in human life activities in various fields that have directly influenced the birth of new forms of legal acts. One of them is gambling in cyberspace. The crime of gambling committed in cyberspace has a serious impact on the order of community life. The government needs to support the development of information technology through legal infrastructure and its regulations to provide legal certainty, so that the use of information technology is carried out safely and free from misuse by paying attention to the religious and socio-cultural values of Indonesian society by forming Law Number 19 of 2016 concerning Information and Electronic Transactions as a consequence of the State of Indonesia as a State of Law. Based on this, the problems in writing this thesis are the first, namely how to enforce the law against online gambling in eradicating criminal acts of online gambling and, second, the factors that hinder law enforcement in eradicating criminal acts of online gambling based on the Law on Information and Electronic Transactions (ITE).
The problem approach used in this thesis is the Legislation and Sociological Juridical approach which is carried out by examining all the Legislation and Regulations related to the legal issues faced and in this study comes from Secondary data supported by Primary data. The population of this study is through the Banyuwangi Police Investigators, the method used in determining this sample is Purposive Sampling. The steps taken in data collection are through Literature Study and Field Study with data processing carried out then evaluated, examined and compiled carefully.
