Abstract

This research takes the formulation of the problem of how the substance of the Constitutional Court Decision concerning Material Test Number Case 97 / PUU-XIV / 2016 viewed from the perspective of human rights enforcement, especially human rights to freely (without pressure) embrace a religion and belief; and Has the Constitutional Court Decision regarding Material Test Number Case 97 / PUU-XIV / 2016 contribute positively to human rights enforcement efforts, especially for religious groups and minority beliefs. This study uses historical approach, literal approach, and conceptual approach. Based on the results of substantial research of the Constitutional Court Decision related to the judicial review of Case No. 97 / PUU-XIV / 2016 viewed from the perspective of human rights enforcement, especially human rights to freely (without pressure) embrace a religion and beliefs at least meet philosophical, juridical and sociological reasons . Whereas the Decision of Constitutional Court Number 97 / PUU-XIV / 2016 concerning the judicial review of the Population Administration Law is based on the attitude of believers who feel unfairly treated (discrimination) in obtaining their rights as citizens who get KK and electronic ID card. where, in their KK and KTP electronic religion columns, were forced to be vacated because of the belief that they believed were not included in any of the six religions recognized by the government and some other discriminatory experiences.
