Abstract
The implementation of Article 46 of the Hospital Law regarding losses arising from medical negligence in hospitals or incidents occurring in healthcare facilities shows that there are service standards that are not followed and service quality that does not meet patient safety. This study aims to analyze the implementation of Article 46 of Law Number 44 of 2009 concerning Hospitals in the context of losses arising from the negligence of medical personnel at RSUD Bangil. This article stipulates that hospitals are legally responsible for all losses caused by the negligence of healthcare workers. The legal research method used is empirical juridical to understand how the implementation of Article 46 of the Hospital Law and the procedures for handling losses arising from medical negligence at Bangil Regional Hospital, as well as the form of the hospital's accountability for losses as stipulated in Article 46 of the Bangil Hospital Law. The research results indicate that the hospital can be held accountable if negligence by medical personnel is proven. If negligence is proven, or if the loss is caused by the intentional actions of medical personnel, then the hospital is responsible, and the medical personnel can also be held accountable for the negligence they committed, leading to the losses incurred
