ANALISIS YURIDIS SOSIOLOGIS PELAKSANAAN GANTI RUGI PEMBEBASAN TANAH UNTUK PEMBANGUNAN GRASS ROOT REFITENERY(GRR) (STUDI DI DESA SUMURGENENG KECAMATAN JENU KABUPATEN TUBAN)

Land acquisition is an activity undertaken by the government to provide land. The land will be used for development for the public interest. One such development for the public interest is the construction of an oil refinery in Sumurgeneng Village, Jenu District, Tuban Regency. The challenge lies in the compensation process between the land-requiring party and the affected community. This research employs a juridical empirical method to analyze the research questions: (1) how is the compensation process carried out by Pertamina towards the affected community in Sumurgeneng Village, Jenu District, Tuban Regency? and (2) what are the inhibiting factors faced in the process of settling compensation for the release of land rights to residents of Sumurgeneng Village, Jenu District, Tuban Regency? The compensation carried out by Pertamina has adhered to the applicable regulations, encompassing the inventory and identification of land possession, ownership, use, and utilization; compensation assessment; negotiation to determine compensation; provision of compensation; and land release from institutions. However, hindering factors such as community rejection, uncertainty regarding land ownership, and a lack of public understanding of theland acquisition.
