Abstract
Traditional arts such as Tari Gandrung are part of Indonesian cultural heritage and should be acknowledged to prevent misrecognition by other parties. The lack of specific regulations regarding this issue and limited public awareness about appreciating cultural legacies are factors that need further investigation. This study aims to explore legal protection for Tari GAndrung Banyuwangi based on the Bern Convention and Law Number 28 year 2014 concerning Copyrights. Using a Juridical-Normative method with primary data from the Bern Convention and Law Number 28 year 2014 concerning Copyrights, the research collects data through literature studies and analyzes them using descriptive methods. The findings indicate that legal protection for Tari Gandrung under the Bern Convention must fall within broader legal protections to prevent misuse. As members of Bern Convention, the government of Indonesia has responsibilities to provide protection and promote Tari GAndrung via relevant laws and policies, along with international efforts ensuring its recognition and appreciation globally. According to Law Number 28 year 2014 concerning Copyrights, Tari GAndrung falls under creations governed by law, thus it receives exclusive rights and moral rights to protect culture and artistry against changes or distortions. Protecting Tari GAndrung is essential to avoid exploitation while recognizing its historical and artistic value. Based on Law Number 28 year 2014, acknowledging these performances can have significant impacts both economically and culturally.
