Abstract
Article 8, paragraph (3) of Law No. 11 of 2012 on Juvenile Justice states that diversion should consider the victim’s interests, child welfare, avoiding negative stigma, and social harmony. This study reviews how diversion is applied to children who are victims of sexual crimes at the Women’s and Children’s Services Unit (PPA) in Polresta Malang Kota. Diversion aims to solve children’s legal issues outside of court through restorative justice. Using empirical legal research, data was gathered from interviews with PPA investigators. The study found challenges such as limited social worker support, lack of child-friendly facilities, and low public awareness of restorative justice. These challenges reduce the effectiveness of diversion and slow children’s emotional recovery. The study recommends more support for the PPA and educating the public on restorative justice to ensure fairer, child-friendly legal processes.
