Abstract
Online gambling is a deviation that is contrary to religious, moral, decency and legal norms, but is increasingly common and difficult to eradicate. Online gambling is now increasingly embedded in humans, difficult to get rid of and is considered a crime. Criminal law is often used to solve social problems, especially in dealing with crime. Especially the problem of gambling as a form of social disease. The issues discussed are as follows: Are the legal considerations by the judge in decision number: 96/Pid.Sus/2019/PT.Mdn in accordance with aspects of justice? The aim of this research is to explain criminal law sanctions for online gambling perpetrators. Based on research results, criminal legal sanctions for online gambling perpetrators in Indonesia have been regulated clearly and firmly in article 303 paragraph 3 of the Criminal Code in conjunction with, article 1 of Law no. 7 of 1974 jo, and article 27 paragraph (2) of the ITE Law. In the case of decision number: 96/Pid.Sus/2019/PT.Mdn which reviews the legal principles of the judge's decision, with a lighter prison sentence than that demanded in the indictment by the public prosecutor. The judge's decision carried out the criminal offense that had been served by the defendant with a prison sentence of 1 year and 6 months. However, the judge's decision is very contrary to the government's aim of providing a deterrent effect to perpetrators and online gambling bookies compared to appeals made by public transmission.
