Abstract

Synchronization is a very important indicator in creating legal certainty and stability in a country by aligning existing regulations to work effectively and efficiently. In the legal context, synchronization refers to the process of aligning and integrating different legal regulations that may have discrepancies or even conflicts with one another. This research analyzes the Synchronization of the Minister of Public Works and Public Housing Regulation Number 16 of 2017 with Positive Law Regarding Non-Cash Transactions on Toll Roads. The research problem formulation focuses on two key issues: (1) how the Minister of Public Works and Public Housing Regulation Number 16 of 2017 aligns with Law Number 7 of 2011 on Currency and Law Number 8 of 1999 on Consumer Protection in the context of non-cash transactions on toll roads; and (2) what legal implications arise from the lack of synchronization between the Minister of Public Works and Public Housing Regulation Number 16 of 2017 and Law Number 7 of 2011 on Currency and Law Number 8 of 1999 on Consumer Protection concerning the rights and obligations of consumers and toll road operators in implementing non-cash transactions on toll roads. This study employs a normative juridical research method by collecting legal materials through literature study. The results show that there is a lack of synchronization between the Minister of Public Works and Public Housing Regulation Number 16 of 2017 and Law Number 7 of 2011, as well as Law Number 8 of 1999. These discrepancies are evident in the implementation of non-cash transactions on toll roads. The consequences of this lack of synchronization include conflicts between lower-level regulations and higher-level regulations, which result in various legal implications for toll road users. Synchronizing these regulations is necessary to ensure that all regulations operate harmoniously without causing legal conflicts that could disrupt the implementation of policies and public interests.
