ANALISIS YURIDIS PEMBATALAN PERKAWINAN AKIBAT PEMALSUAN DATA (Studi Putusan No.1180/Pdt.G/2024/PA.Bwi)

The purpose of this research is to understand the legal basis that judges use as considerations in deciding cases and to determine the legal implications of the annulment of marriage. This type of research is normative juridical using the statue approach method, using primary and secondary data sources related to annulment of marriage. Marriage is considered valid if it meets certain requirements including, the minimum age of the prospective spouses and the consent of both parties. If these conditions are not fulfilled, the marriage that has taken place can be annulled through legal channels. Based on the decision of the case No. 1180/Pdt.G/2024/PA.Bwi at the Banyuwangi Religious Court, in this case, both parties are still below the age stipulated by law and do not have the necessary marriage dispensation. This resulted in their marriage being declared invalid and ultimately led to its annulment. The results of this research are expected to provide a deeper understanding of the annulment of marriages due to underage marriages without dispensation. This research concludes that the annulment of marriage in Decision No 1180/Pdt.G/2024/PA.Bwi, carried out by the judge, based on the provisions of the Marriage Law and the Compilation of Islamic Law.
