Abstract

ABSTRACT
Surabaya district court number 13/PID.B/2023/PN.Sby, the judge stated that the Defendant is acquitted and declared not guilty based on the considerations with all the evidence and witnesses presented in the trial. A good decision is one that demonstrates how justice is upheld through a systematic legal reasoning process and the fulfillment of justice indicators, particularly in substantive justice. Through normative legal research by examining legislation and literature/doctrine as well as case comparisons. In the Surabaya District Court Decision Number 13/Pid.B/2023/PN Surabaya, the reasoning process carried out by the judge was deemed less accurate because it did not pay attention to the systematic steps of the legal reasoning process and was too focused on one aspect, causing other facts to be overlooked. The judge's considerations in this ruling are also deemed to not meet the indicators that serve as parameters for substantive justice. The indicator of substantive justice used as a parameter of justice contains the values of honesty, objectivity, rationalism, and imperialism.
