Abstract
One of the regulations that protects IPR is Law Number 28 of 2014 concerning Copyright or commonly known as the Copyright Law. Specifically, protection for photography copyright is in Article 40 letter K of the Copyright Law. The problem that arises is the ineffectiveness of Law Number 28 of 2014 concerning Copyright in conjunction with Law Number 11 of 2008 concerning Information and Electronic Transactions in this modern era which is deemed less effective considering the increasingly rapid development of social media. More and more photographers are uploading their work on social media, but the existing legal protection is felt to be less strict in providing legal certainty. The aim of this research is to find out the legal protection for photography copyright uploaded on social media without the creator's permission and to find out sanctions and efforts to resolve legal violations of photography copyright uploaded on social media without the creator's permission. The research method in this research is Normative Juridical. The research was carried out by analyzing problems with the law as the test knife. The theory used is the theory of legal protection which specifically protects creators/non-copyright holders. Legal protection for photography copyright is through preventive and repressive legal protection. If there is a violation of photography copyright, legal action can be taken in two ways, namely litigation and non-litigation. Suggestions that can be taken from this research are that the public needs to increase awareness of photography copyright protection, the government needs to strengthen existing regulations, and creators need to provide identification marks on their photographic works.
