Abstract
Online fraud is widespread in Indonesia and harms victims financially and psychologically. This is important to handle because it is included in the category of criminal acts. The crime of online fraud is regulated in Article 378 of the Criminal Code which regulates fraud in general forms, as well as Article 378 Bis and Article 378 Ter of the Criminal Code. In this case, the phenomenon that can be found in the case study, namely decision Number 526/PID.SUS/2020/PT SBY, is the lack of public awareness of the dangers of online fraud as a criminal act that is very self-defeating. This research aims to analyze the juridical principle of expediency in imposing criminal sanctions on perpetrators of criminal acts of online fraud with a case study of decision Number 526/PID.SUS/2020/PT SBY. The method used in this writing is normative juridical with a statutory approach (statue approach) and case approach (case approach) as well as data collection techniques using literature study. The conclusion in this decision is regarding juridical considerations, namely the judge's decision which only imposes sanctions of imprisonment and fines which are not in accordance with the principles of expediency and justice, then this decision needs to be evaluated further to ensure that the criminal sanctions imposed fulfill the principles of justice and provide adequate benefits. for victims. Monitoring and corrective action is required if the decision is deemed inadequate in this regard. Thus, efforts to improve justice and usefulness in the criminal justice system can continue to be improved to provide better protection for victims
