Abstract

This research examines the legal consequences that occur due to the fictitious
activities of notaries in making notarial deeds of name-borrowing agreements
(nominees) which are reviewed based on the Civil and Criminal Codes and also the
notary's code of ethics. The research method used in this research is the normative
juridical method. Apart from that, the research approach used in this research is a
statutory approach. Data collection techniques using library studies and research
document studies. The legal material analysis technique is a descriptive analytical
method that describes existing problems and is then analyzed based on statutory
regulations relating to nominee agreements. Based on this research, the results
were obtained that in the practice of making a notarial deed of a name borrowing
agreement (nominee) by a notary, the force of the notarial deed can be revoked by
law. Apart from that, if it does not fulfill all the provisions in the Civil Code, its
power can be revoked by law. Apart from that, the agreement to borrow the name
(nominee) also has indications of violating the provisions of the Criminal Law and
the Notary's code of ethics.
