Abstract

The criminal act of abuse committed by children against children was committed in Tulungagung Regency, East Java. This research aims to determine the factors that cause criminal acts of abuse committed by children and to find out how the diversion penalty is applied in cases of criminal acts of abuse committed by children. This research problem was analyzed using the theory of the causes of crime. The resulting research results are the application of diversion penalties carried out by the prosecutor's office in cases of abuse committed by children against children which refers to the Criminal Code. Diversion can be carried out with the victim's consent with the threat of a sentence of less than 7 (seven) years and is not a repetition of the crime in accordance with the SPPA Law article 7 paragraph 2, but if the victim does not want diversion then the punishment process will continue. When asked about the factors that cause criminal acts against children by minors, it is believed that there are individuals who are provocateurs, psychological, biological, economic problems and lack of knowledge. Therefore, it is very necessary for parents to pay attention to their children to overcome these criminal acts.
