Abstract

Rape is a crime that is very heinous, immoral and despicable and violates norms where the victims are women, both adults and minors. The perpetrators of the crime of rape are often people known to the victim and some even still have a family relationship and the most alarming is a father who has the heart to rape his own biological child (incest). This thesis examines the criminological review of rape committed by fathers against biological children (case study at Malang City police station) where this study aims to find out two things, first to find out the factors that cause the criminal act of rape committed by fathers against biological children, second to find out the legal efforts made by the police against the criminal act of rape of fathers against biological children. This thesis is prepared using empirical juridical research methods while the data obtained through interviews with sources. Then the data obtained is analyzed so that it can reveal the results and conclusions of the expected problems. In this thesis, the researcher found that the main factor influencing the criminal act of rape against biological children is the opportunity obtained by the perpetrator so that he can easily satisfy his lustful desires, so that the perpetrator must get an appropriate and appropriate punishment.
