TANGGUNG JAWAB PIDANA TENTANG TERJADINYA KECELAKAAN YANG DIAKIBATKAN KERUSAKAN JALAN DI DESA PASIRIAN KECAMATAN PASIRIAN KABUPATEN LUMAJANG

This research discusses criminal responsibility related to accidents caused by road damage in Pasirian Village, Pasirian District, Lumajang City. The purpose of this study is to analyze how criminal responsibility is applied to road operators who are negligent in repairing road damage that causes accidents. The research method used is qualitative with a case study approach. Data were collected through interviews, observations, and document studies. The results show that there is negligence from road administrators in repairing road damage that has an impact on the occurrence of traffic accidents. Factors such as lack of routine maintenance and slow response to reports of road defects contributed to the occurrence. The study also found that law enforcement against negligent road operators is weak, leading to a lack of accountability and an increased risk of accidents. Therefore, this study suggests improvements in the road maintenance system as well as stricter law enforcement against negligent road operators. The conclusion of this study is the importance of strict law enforcement against road operators to reduce the number of traffic accidents due to road damage and improve road user safety. It is also expected to encourage the improvement of the quality of road infrastructure in the region, thus creating a safer and more orderly traffic environment.
