PENEGAKAN HUKUM ATAS PELANGGARAN PASAL 9 AYAT (1) PADA PERDA KOTA BATU NO. 10 TAHUN 2020 TENTANG KAWASAN TANPA ROKOK

Cigarettes are one of the main causes of various serious diseases such as heart disease, lung cancer and chronic respiratory disorders. Smoke from cigarettes is very disturbing to the surrounding area and can pollute the air that people breathe. The existence of Batu City Regional Regulation number 10 of 2020 concerning No-Smoking Areas aims to increase legal awareness and norms of healthy behavior in society and enforce compliance with existing regulations. This article aims to find out and analyze, firstly, how to enforce the law for violations of article 9 paragraph (1) Batu Regional Regulation number 10 of 2020 concerning No-Smoking Areas and Second, what are the obstacles to law enforcement regarding violations of article 9 paragraph (1) Batu Regional Regulation number 10 of 2020 concerning Non-Smoking Areas. The method used in writing is sociological juridical and uses primary data and secondary data with data collection techniques using interviews, observation and documentation. The results of the discussion in this research show that regional law enforcement has been partially implemented well, namely the administration of administrative sanctions in the form of verbal warnings. However, there are obstacles to law enforcement, namely law enforcement, community and cultural factors. The author suggests that law enforcers should be more assertive in carrying out their duties and also increase public awareness of the health of the surrounding environment.
