Abstract
The MUI institute made a fatwa to forbid vasectomy and tubectomy through a fatwa that has been issued since 2009. This fatwa was made based on the opinions of experts and studies from the perspective of Islamic law, that contraception results in permanent sterilization and is prohibited in Islamic law. What makes contraception permissible is that it involves monitoring the menstrual cycle to determine when ovulation occurs and avoiding sexual intercourse during potentially fertile periods. This article aims to find out the MUI fatwa regarding vasectomies and its relevance to the principles of maqashid sharia. Writing this research uses a library research method with a descriptive qualitative approach. The primary source for this writing uses Jasser Audah's work entitled "Grounding Islamic Law Through Maqashid Syariah". Meanwhile, the secondary sources used are the 2012 MUI fatwa and data that can be obtained from supporting literature from primary sources, such as journals, books and other reliable references. The results of this research show that vasectomy for men and tubectomy for women, in principle, cannot be justified by Islamic law because it causes the acceptor (in this case the husband), to experience a loss of reproductive function, although not completely. Because vasectomy only inhibits the release of semen cells in the male reproductive organs. Because it is feared by wives as an opportunity to commit extramarital affairs. Unless it is an emergency for the benefit desired by the husband and wife, there is no prohibition on restricting offspring (vasectomies and tubectomies) because the aim is to achieve mutual benefit and prosperity.
