Abstract

Credit card fraud is a crime in cyberspace or electronically based. This crime still occurs frequently, endangering credit card users. Even though currently there are provisions governing electronic crimes, law enforcers often use the
KUHP as the legal basis for criminalization. The focus of the problem in this research is what are the characteristics of credit card fraud crimes? what efforts can be taken to prevent carding? and How are carding regulations formulated in
criminal law and harmonized in the UU ITE?. The research method used is a normative juridical research method. Data sources were obtained from primary and secondary legal materials. Based on the results of research and discussion, it was found that there are several differences in the characteristics of criminal acts of credit card fraud. This can be seen from the methods used by the perpetrator to commit the crime. The criminal act of credit card fraud always consists of, at a minimum, two criminal acts, namely the first is identity theft, and the second is the criminal act of credit card fraud itself. There are 3 (three) state institutions that have made efforts to prevent carding crimes, namely the Financial Services Authority (OJK), Police and Banking. The role of these 3 (three) state institutions is very important in preventing the occurrence of criminal acts of carding. The use of provisions in the KUHP for carding crimes is no longer relevant as a basis for prosecuting carding crimes, even though in fact in carding crimes the essence of the crime is taking advantage of the theft of other people's credit card data. ith the UU ITE, it is more appropriate to use it in prosecuting carding crimes. This is also based on the implementation of the criminal act, namely via a computer or using an internet connection network media.
