Abstract

This research discusses consumer legal protection for property buyers using the pre-project selling system with a case study of the Manali Hill Residence housing complex which experienced construction failure. The formulation of the problem raised by the researcher is how to legally protect property consumers if the building is not built due to the developer's negligence, viewed from the perspective of Government Regulation Number 12 of 2021 concerning Amendments to Government Regulation Number 14 of 2016 concerning the Implementation of Housing and Settlement Areas. The research method used is a sociological juridical research method. The data source was obtained from interviews with 3 buyers who experienced losses and the Director of PT Notojoyo Nusantara Developer. The results of research and discussion show that the causes of losses experienced by buyers of Manali Hill Residence are failed construction and problems with ownership of land rights. Until now, the developer has not provided compensation to these buyers. Even though PP 12/2021 has indicated that there will be efforts to compensate for losses. Meanwhile, the form of consumer protection in PP 12/2021 has provided an obligation for developers to provide compensation for losses resulting from failed construction caused by negligence.developer that is, no later than 30 (thirty) calendar days after the cancellation letter is signed.
