Abstract

Land use was important in its handling, since it related with society needs. From the government needs for various development, there found that the land owed by a country was so limited. The only way was by people land-use - whether it ruled by custom law or the other rights on it. The research statement of problems were: (1) How the implementation process and the base consideration in land use to widen Bugul Kidul street - Bugul Kidul Sub-District? (2) How the discussion process and the compensation in land-use application to widen Bugul Kidul street - Bugul Kidul sub-district? (3) What effect existed in economic condition for land owner caused by the land use? Research method used in the research was socio juridical with location at Bugul Kidul street of Bugul Kidul sub-district Pasuruan City East Java, where there was a widening process on the street. The research showed that implementation process and basic consideration in the land-use was project progress of Certain Non-Vertical Work Unit General Department (Departemen Pekerjaan Umum Satuan Kerja Non Vertikal Tertentu - SNVT). Street and bridge development in East Java needed land-free procedure, but there was no agreement with the society. In discussion process, there was no inhibition, from the agreement process, the exchange had no problem, the agreement was reached in 8 days, also the amount of exchange would be given according to NJOP. In this land-use, people didn't feel the effect influenced their economic condition though they loss some of their land.
