Abstract

Narcotic handling in Indonesia became the responsible of society, people, and related institutions. In this research, the writer tried to find the way of investigating officer in securing evidence. In this research, the writer used socio-juridical approach with data source consisted of interview, observation, and documentation. While in Data analysis, the writer used qualitative descriptive method. From the research, there could be concluded that in doing evidence confiscation along narcotic criminal, the investigating officer should get permission letter from the Chief of State Court, except while there was something needed, so that the investigating officer could do raid which continued by confiscation of narcotics. In securing the evidence, 1/3 part of hashis from Sudarmono and Anjar case aimed to prove the case in the court, but ¾ part of the hashis was not found and not match with Police Officer Decision No. Skep/1205/IX/2000 about The Collection of Technical Process of Criminal Case. The investigator action was still out of sanction. It could influence the narcotic eradication and the law effectiveness would be blocked. From the research, the writer could suggest that for investigating officer, in doing confiscation, they should be honest and doing the procedure as the existing procedure stated in the technical journal statement / Law of Judicial Procedure. The most important things also tight security on the House of Country Confiscation to the confiscation things and the stright action to the subject of criminal law without considering his/her wealth in confiscation process.
